By using the services provide by Yummy Mummies Fitness you are bound by these Terms and Conditions. Make sure you read through them carefully and that you understand them before signing the disclaimer form.
These terms and conditions will apply to anyone booking any services or making any orders via the website or directly with Yummy Mummies Fitness via email or by phone. They explain what you can expect from us and what we can expect from you and cover all services provided by Yummy Mummies Fitness
These Terms and Conditions set out the whole agreement between you and us for the supply of goods and / or services and constitute an agreement between you and us. Please ensure that you read and understand these Terms and Conditions because you will be legally bound by them. “Yummy Mummies Fitness” “us” “we” “our” “trainers” and “instructors” means Yummy Mummies Fitness.
1. Booking:
1.1 You must book for all classes/courses unless otherwise stated by contacting the instructor and ensuring there is a space available. Once confirmation has been given you must book onto the class/course in order to secure your place.
1.2 Your booking is unique to you and is non-transferable to another person.
1.3 You must pay for the class/course 12 hours prior to the beginning of the class/course via the online booking system.
1.4 You must ensure that you check the date, time and location of the class/course you are booking on to and ensure it is the correct one. Failure to do so may result in you not being able to attend. Transfer to the correct course will only be possible if there are spaces available.
1.5 If you purchase by PAYG you must book onto the date of your chosen class. Please book at least 12h prior to the class start time.
1.6 Once you have completed registration it indicates you have read and agreed to the terms and conditions set out within this document.
1.7 If you place a booking and do not receive confirmation of successful completion within 2 hours of placing your booking, please let us know. Please check your spam folder for this.
1.8 Failure to book and secure your place may result in you being turned away from classes/courses.
1.9 There is a £5 non-refundable deposit which will be deducted from course totals on full payment. You can pay for your course via online booking, cash or internet banking. Payment in instalments is not possible.
2. Block Bookings:
2.1 All Block Bookings purchased from Yummy Mummies Fitness are valid for the dates given at the time of booking. If there are sessions left after the date given they become invalid.
2.2 If more than 10% of sessions booked are cancelled in violation of the cancellation policy then Yummy Mummy Fitness reserves all rights to refund monies paid for by you less a 20% cancellation fee. If this is to happen the trainer’s obligation to the client and the training will terminate immediately 24 hours after notice to the client has been served.
3. Refunds and Cancellations:
3.1 Refunds: on any pre-paid courses will only be given with a doctor or midwife note stating that the individual is unfit to exercise. In the case where an individual gives birth the remaining sessions missed will either be refunded or taken off your first post-natal course.
3.2 All packages are non-refundable and non-transferrable. We are under no obligation to refund or transfer your money if you are unable to attend one or more classes in the term – including the reasons of holidays and sickness. Bookings cannot be cancelled once payment for the course has been processed. We will endeavour to offer an alternative for a missed class however we regret that we are not always able to do so.
3.3 Classes booked using PAYG are non-refundable if cancelled within 24h of the class start time. If cancelled with more than 24h until the class start time then a transfer to another date will be offered. Should a refund be required, please contact us via email at info@yummymummiesfitness.co.uk.
3.4 We have the right to cancel classes without refund in exceptional circumstances beyond our control (including but not limited to fire, flood, vehicle breakdown, serious illness, treacherous snow etc). Wherever possible we will either run a virtual class or arrange a catch-up class at an alternative time, however, this is not guaranteed.
3.5 In the event of lockdown or a similar COVID-19 event preventing face to face sessions going ahead then the sessions will either be offered virtually, rescheduled for a later date or the balance will be credited to your account. This will be decided by us at the time.
3.6 Course Cancellation by us: In the event of Yummy Mummies Fitness being unable to deliver your class/course for any reason outside our control, we will reschedule your class/course as soon as possible free from any additional cost.
3.7 Class times and location are subject to change. This will be only occur on a new “term” and will be communicated when the new term dates are announced.
3.8 We reserve the right to amend class times and format should the minimum class participant number (3 participants) not be reached. In this case participants will be contacted and given the choice to have a refund or accept the new class time.
3.9 Term dates and breaks between terms will be variable in length and will be announced when booking becomes open for the next term.
3.10Course Cancellation by you: You must give no less than 48 hours notice before the start date of the course to ensure a refund minus the £5 non-refundable deposit. If cancellation falls after the 7 working days and the course has already been paid in full no refund will be made. For classes cancellation within 24hours will be fully refunded.
3.11Non-attendance: If you are unable to attend the course due to
a. Exceptional circumstances: i.e. bereavement, medical grounds or you are a parent or carer and your dependent is taken severely ill, then a refund for the course will be given in line with clause 3.1.
b. For any other reason you will be able to book in for another course, subject to availability, and payment of the full course again which must be made through internet transfer before the beginning of the course.
3.12Non-Completion: If you are unable to complete the course because
a. You give birth during the course period you may either receive a refund for the remainder of the course period (see clause 5), or transfer the classes left over to a post-natal class.
b. See clause 3.1.
4. Participation:
4.1 You must complete a Medical Screening Form before commencing in either classes or personal training sessions.
4.2 If need be your instructor may need a letter of ‘medical consent’ from your GP. Please be aware your GP may charge for providing this letter, if this is the case you must fund it.
4.3 Yummy Mummies Fitness Staff cannot be held liable in any way for undeclared or unknown medical conditions.
4.4 For Yummy Core classes you must be at least 6 weeks post birth, 12 weeks post c-section, and must be signed off by the GP to commence exercise after your 6–8-week check.
4.5 For Yummy Circuit classes you must be at least 12 weeks post natal, fully recovered with no pelvic floor dysfunction and no diastasis due to the nature of the class.
4.6 You must wear appropriate clothing and footwear for physical activity. Clothing should be non-restrictive, and footwear should be comfortable and provide adequate support.
4.7 Please bring water to class and any medication required (e.g. asthma inhalers).
4.8 You must be over the age of 16 to take part in Yummy Mummies Fitness classes.
4.9 You must inform Yummy Mummies Fitness Staff of anything that may prevent you from completing all the activities so that an alternative can be given if suitable.
4.10 If you are late to a session, you may not be permitted entry into the class, due to health and safety
4.11 If the instructor is late to a class then additional time will be added to the following week’s class.
4.12 It is recommended you arrive to class 5 minutes prior to the start time to get set up and be ready for the warm up to commence.
5. Participant Responsibilities
5.1 You must disclose to your instructor if you should not take part in physical activity (due to reasons such as, but not limited to, injury, pregnancy or birth, ill-health or injuries). Your trainer cannot be held liable in any way for any undeclared or unknown conditions.
5.2 You agree to complete your online registration form and your pre-screening form with accurate information.
5.3 Wherever possible alternative exercise options will be given to account for common issues a post-natal participant may have, however, all individual participants are responsible for ensuring they only take part in exercises that are safe and appropriate for them to do without causing any discomfort or pain. Please speak to your instructor if you feel any discomfort or pain, and / or need any alternatives.
5.4 You understand that there are inherent risks in participating in a physical activity class.
5.5 If you have an accident or injure yourself at one of our classes, you must report this to the instructor straight away. If you sustain or claim to sustain an injury whilst participating in class, you acknowledge that the trainer is in no way responsible, except where the injury was caused by their gross negligence or an intentional act.
5.6 Should you experience unusual feelings or symptoms during the sessions please report it to your instructor straight away.
5.7 Please keep all possessions safe during classes. We will not take responsibility if valuables are damaged, lost or stolen.
5.8 Your participation is voluntary, and you can change your mind or stop the session at any stage.
5.9 You understand that the results of any fitness class cannot be guaranteed. Your progress depends on your effort and commitment in and outside of class.
5.10 You must not put the health, safety or wellbeing of other attendees, your instructor or any member of the public at risk.
5.11You must not behave in a violent, rude or threatening way or in a manner which distresses or causes discomfort to other class members or instructors.
5.12 We may refuse admission to or ask you to leave the relevant class if your instructor reasonably believes that you have broken any section of the above statement. No refund will be given if you are asked to leave a class in such circumstances
6. Babies, Toddlers, Children
6.1 Babies, toddlers and children are always welcome along to the classes. However they are not allowed to take part in any form of the exercise or use the equipment.
6.2 If your child is present with you during a session, you are fully responsible for their health and safety.
6.3 They must remain in a buggy, car seat or in your own exercise area. If they need to be attended to, you must stop exercising and attend to them.
6.4 They must not be held or attended to whilst you are exercising as this may lead to injury.
6.5 Parents are asked to keep their children at home if they have a serious infection and to inform us as to the nature of the infection so that other parents can be alerted.
6.6 I understand that on occasions it may be necessary for my instructor to handle my child and I give full consent to this.
7. Trainer Obligations
7.1 All our instructors are fully qualified fitness instructor and personal trainer and hold post-natal qualifications.
7.2 The instructor will use their skills and knowledge to design an appropriate exercise class for class participants.
7.3 All instructors are first aid qualified with a minimum of Emergency First Aid at Work.
7.4 The instructor is responsible for ensuring any equipment provided is in good working order and ensuring a safe exercise environment.
7.5 All our instructors hold an up to date DBS form.
8. Liability: to the maximum extent permitted by law:
8.1 Yummy Mummies Fitness will not in any circumstances accept any liability for any loss or damage of any property brought into a class or session.
8.2 We will not in any circumstance accept any liability whatsoever for any loss that may arise out of the use of this website (www.yummymummiesfitness.co.uk) or services purchased from Yummy Mummies Fitness or any damage howsoever caused.
8.3 We will only be liable for direct loss up to a maximum total of the price of the session or class purchased in respect to any claim.
8.4 We are not liable if you ignore our recommendation, at any time, to seek medical advice.
8.5 We do not accept liability for any errors and omissions and reserve the right to change information, descriptions and prices of listed packages and services. The trainer will do their best to correct errors and omissions as quickly as practical after being notified of them.
8.6 We do not accept any liability whatsoever for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of services purchased from us or any other damage howsoever caused.
8.7 We will not be liable for any loss or damage caused by a virus or other technologically harmful material that may infect your computer equipment, computer programs or data due to your use of our sites or to your downloading of any content on them, or on any website linked to them.
9. Online Account
9.1 In order to book our services, you will have to create an account.
9.2 You will log into your online account with the email address that you gave us as part of your registration process.
9.3 You will be responsible for keeping your account password secure and confidential.
9.4 You must notify us immediately of any breach of security or unauthorised use of your account that you become aware of.
9.5 You must keep your contact details in your online customer account up-to-date because we use this information to contact you if classes are to be held virtually or are cancelled.
9.6 We have the right to disable any account, at any time, if in our opinion you have failed to comply with any of these terms and conditions.
9.7 As an account holder, you acknowledge that you have read and understand the provisions of the Privacy Notice found on our website and that you agree that we may collect, use, process and disclose your personal information as described.
10. Intellectual Property
10.1 Any materials, whether hard or soft copies, made available to you by Yummy Mummies Fitness will at all times remain the property of the instructor and is subject to copyright.
10.2 You undertake to use such materials only for your own personal, non-commercial, use and not to copy, republish, reproduce, or share any such materials.
10.3 You also agree not to adapt, alter or create a derivative work from any of our content except for your own personal, non-commercial use. Any other use of our content requires the prior written permission from us.
10.4 If you print off, reproduce, copy or download any part of our site in breach of these terms of use, your right to use our sites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
10.5 The names, images and logos identifying us or third parties and their products and services are subject to copyright, design rights and trademarks of us and/or third parties.
10.6 The content on our sites is provided for general information only. It is not intended to amount to advice on which you should rely. Although we make reasonable efforts to update the information on our sites, we make no representations, warranties or guarantees, whether expressed or implied, that the content on our sites are accurate, complete or up-to-date.
Privacy and Data Protection: to assist us with improving the service we offer to you, from time to time we may ask you for up to date personal information such as name, age, contact details, etc. This information may be used for direct marketing purposes within Yummy Mummies Fitness and from time to time you may receive direct marketing from us. If at any time you decide you do not want to receive any direct marketing information, please notify us and your personal details will be removed from our database as soon as possible. Your details will never be passed onto third parties without your prior consent.
All personal data held by Yummy Mummies Fitness is done so in accordance with the Data Protection Act 1998.
Miscellaneous: Yummy Mummies Fitness may amend these terms and conditions from time to time, and place a new version on the website. All course location, times, and venues from the date of the amended terms are placed on the website onwards will be governed by those new terms.
